These laws were already introduced for larger businesses in 2024 and are now being extended across all workplaces.<\/p>\n<h3 data-start=\"459\" data-end=\"481\"><\/h3>\n<h3 data-start=\"459\" data-end=\"481\">What the Law Means<\/h3>\n<p data-start=\"483\" data-end=\"505\">Under the new rules:<\/p>\n<ul>\n<li data-start=\"509\" data-end=\"647\">Employees have a workplace right to refuse to monitor, read or respond to work-related contact outside of their usual working hours.<\/li>\n<li data-start=\"650\" data-end=\"724\">There are exceptions where the contact is considered reasonable.<\/li>\n<\/ul>\n<p data-start=\"726\" data-end=\"758\">Reasonableness will depend on:<\/p>\n<ul>\n<li data-start=\"761\" data-end=\"810\">the purpose, urgency, and nature of the contact<\/li>\n<li data-start=\"813\" data-end=\"851\">how disruptive it is to the employee<\/li>\n<li data-start=\"854\" data-end=\"896\">the employee\u2019s role and responsibilities<\/li>\n<li data-start=\"899\" data-end=\"956\">personal circumstances, such as family or caring duties<\/li>\n<li data-start=\"959\" data-end=\"1029\">whether the employee is compensated for being available after hours.<\/li>\n<\/ul>\n<p data-start=\"1031\" data-end=\"1142\">These rights apply to contact from the employer, co-workers, or third parties (such as clients or suppliers).<\/p>\n<h3 data-start=\"1149\" data-end=\"1169\"><\/h3>\n<h3 data-start=\"1149\" data-end=\"1169\">Resolving Issues<\/h3>\n<ul>\n<li data-start=\"1173\" data-end=\"1328\">If there is disagreement about whether contact or a refusal was reasonable, both parties are encouraged to resolve the matter within the workplace first.<\/li>\n<li data-start=\"1331\" data-end=\"1447\">If this cannot be resolved, the Fair Work Commission can assist, including through \u201cstop orders\u201d if necessary.<\/li>\n<li data-start=\"1450\" data-end=\"1587\">The right is protected under the general protections of the Fair Work Act, meaning employees cannot be penalised for exercising it.<\/li>\n<\/ul>\n<h3 data-start=\"1594\" data-end=\"1635\"><\/h3>\n<h3 data-start=\"1594\" data-end=\"1635\">Why This Matters for Small Businesses<\/h3>\n<p data-start=\"1637\" data-end=\"1837\">The intent of the laws is to promote fairness and clarity around after-hours contact, while still allowing businesses to operate effectively.
